Facts

The appellant was charged in the High Court with murder based on an allegation that he killed his mother. Mr. M.O. Uduma of the Legal Aid Counsel was assigned to the accused by the court.

Mr. Uduma remained absent during most of the life span of the matter and even when present he did not conduct the case professionally. Because of this another counsel also of the Legal Aid was re-assigned to handle the case but his performance was below par.

The learned trial judge convicted the appellant and sentenced him to death by hanging for committing the crime of matricide.

Appellant dissatisfied appealed to the Court of Appeal which dismissed the appeal and confirmed the conviction and sentence of death of the trial court.

Appellant appealed to the Supreme Court.
